Terms of Use
In plain terms: Reasons to Keep Building is a place to read and share anonymous words of encouragement. It is not counseling, therapy, medical care, a crisis service, or business, financial, investment, tax, or legal advice. If you are in danger or thinking about harming yourself, contact emergency services or a crisis line right now. In the U.S., call or text 988. Please don't put your name, anyone else's name, or other identifying details in a letter. By using the site, you accept the terms below.
These Terms of Use ("Terms") are a binding agreement between you and HPVentures ("HPVentures," "we," "us," or "our"), which operates the website Reasons to Keep Building and its related pages and features (collectively, the "Service"). By accessing or using the Service, submitting a letter, or otherwise interacting with it, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What the Service is, and what it is not
The Service is peer encouragement, not professional help. The letters are personal, anonymous messages of support written by members of the public. They are not, and are not a substitute for, professional medical advice, mental-health treatment, psychological or psychiatric care, counseling, therapy, diagnosis, or crisis intervention.
The Service is not a crisis or emergency service and is not monitored in real time. We do not provide, and cannot provide, urgent assistance, welfare checks, or a response to anyone in distress. Do not use the Service to seek emergency help.
If you or someone else may be in danger, or you are thinking about suicide or self-harm, get help immediately. In the United States, call or text 988 (Suicide & Crisis Lifeline) or call 911. Outside the U.S., contact your local emergency number or a crisis line listed on our Find help page.
Using the Service does not create any doctor-patient, therapist-client, counselor, fiduciary, or other professional or confidential relationship between you and HPVentures or any letter writer. You should never disregard, avoid, or delay obtaining professional advice because of anything you read on the Service.
The Service is not business, financial, investment, tax, accounting, or legal advice. The letters reflect the personal experiences and opinions of the individual people who wrote them. They are general in nature, may be inaccurate or incomplete, and are not tailored to your situation. Nothing on the Service is a recommendation to take, or to refrain from taking, any business, financial, or legal action, and no result is promised or implied. Always consult a qualified professional before making decisions about your company, finances, taxes, or legal matters.
2. Eligibility
You must be at least 18 years old to submit a letter, and at least 13 years old to otherwise use the Service. The Service is not directed to children under 13, and we do not knowingly collect information from them. By using the Service, you represent that you meet these requirements and that your use is lawful where you are located.
3. Letters and other content you submit
The Service lets you submit letters and other content (each, a "Submission"). You are solely responsible for your Submissions. By making a Submission, you agree to all of the following.
3.1 Keep it anonymous and safe
- Do not include your full name, contact details, employer, or other information that could identify you or anyone else, and do not include private, confidential, or personal information about any other person.
- Do not use the Service to reach us in an emergency or to report that you or someone else is in immediate danger. We cannot and do not respond to such reports.
- Write to encourage. Do not submit content that is unlawful, harassing, hateful, defamatory, threatening, harmful, sexually explicit, discriminatory, deceptive, or that encourages or instructs self-harm, harm to others, or any dangerous, illegal, or medical course of action.
- Do not submit spam, advertising, solicitations, links, malware, or anyone else's copyrighted or proprietary material, and do not impersonate any person or organization.
3.2 Review, moderation, and no obligation to publish
Submissions are ordinarily reviewed before they may appear, but we do not guarantee review, monitoring, or accuracy, and we are not responsible for content that we have not created. We may, in our sole discretion and without notice, decline, edit, shorten, refuse, remove, or take down any Submission or content at any time, for any reason or no reason. Publication is never guaranteed. We are not liable for any Submission or for any action or inaction regarding any Submission.
3.3 License you grant to us
You retain any ownership you have in your Submission. You grant HPVentures a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, fully paid, transferable, and sublicensable license to host, store, use, reproduce, adapt, edit, translate, excerpt, publish, publicly display, distribute, and otherwise make available your Submission (in whole or in part, and in any media now known or later developed) in connection with operating, providing, and promoting the Service. Because Submissions are anonymous, they may be shown to any visitor an unlimited number of times. This license survives even if you later stop using the Service, though we will remove a specific published letter on reasonable request where we can identify it (see the Privacy Policy).
3.4 Your representations
You represent and warrant that your Submission is your own original work (or that you have all rights necessary to submit it and grant the license above), that it does not violate these Terms or any law or the rights of any person, and that it contains no personal or identifying information about you or others.
4. Acceptable use
You agree not to: (a) use the Service for any unlawful, harmful, or abusive purpose; (b) interfere with, disrupt, overload, probe, or attempt to gain unauthorized access to the Service or its systems, accounts, or data; (c) use bots, scrapers, or automated means to access, collect, or submit content except as we expressly permit; (d) attempt to re-identify anonymous authors or other users; (e) reproduce, redistribute, or create derivative works from the Service's content except your own Submissions; or (f) misrepresent your affiliation with any person or entity.
5. Third-party resources and links
The Service references or links to third-party resources, including crisis lines and mental-health organizations, purely for convenience. We do not control, operate, endorse, or assume any responsibility for those resources or their content, availability, or services, and listing them is not a referral, recommendation, or warranty. Your interactions with any third party are solely between you and that third party.
6. Intellectual property
The Service, including its design, text we author, graphics, logos, the "Reasons to Keep Building" name and marks, and the compilation and arrangement of all content, is owned by HPVentures or its licensors and is protected by intellectual-property and other laws. Except for your own Submissions and except as expressly permitted, you may not copy, modify, distribute, sell, or exploit any part of the Service without our prior written consent.
7. Disclaimers of warranties
THE SERVICE AND ALL CONTENT, INCLUDING ALL LETTERS AND ALL THIRD-PARTY RESOURCES, ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, HPVENTURES DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE, OR THAT ANY CONTENT IS ACCURATE, RELIABLE, COMPLETE, OR SUITABLE FOR YOUR SITUATION. YOU USE THE SERVICE AND RELY ON ANY CONTENT AT YOUR OWN RISK.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HPVENTURES AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS (THE "HPVENTURES PARTIES") WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE ABOVE, THE HPVENTURES PARTIES WILL NOT BE LIABLE FOR ANY DECISION MADE OR ACTION TAKEN OR NOT TAKEN BY YOU OR ANY OTHER PERSON IN RELIANCE ON THE SERVICE OR ANY CONTENT, INCLUDING ANY LETTER, OR FOR ANY PHYSICAL, PSYCHOLOGICAL, EMOTIONAL, FINANCIAL, OR OTHER HARM OF ANY KIND, INCLUDING DEATH OR SELF-HARM. TO THE FULLEST EXTENT PERMITTED BY LAW, THE HPVENTURES PARTIES' TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU; IN THAT CASE, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
9. Indemnification
You agree to indemnify, defend, and hold harmless the HPVentures Parties from and against any claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your Submissions, your use of the Service, or your breach of these Terms or of any law or third-party right.
10. Governing law and disputes
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the Commonwealth of Puerto Rico, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at Results@HighPerformanceVentures.com and attempt in good faith to resolve the matter informally for at least 30 days. Any dispute that cannot be resolved informally will be brought exclusively in the courts located in San Juan, Puerto Rico, and you consent to the personal jurisdiction and venue of those courts. To the extent permitted by law, any claim must be brought within one (1) year after it arises.
11. Changes to the Service and these Terms
We may modify, suspend, or discontinue the Service or any part of it at any time. We may also update these Terms from time to time; the "Last updated" date shows when. Material changes will be reflected on this page, and your continued use of the Service after changes take effect means you accept the updated Terms.
12. General
These Terms and the Privacy Policy are the entire agreement between you and HPVentures regarding the Service. If any provision is held unenforceable, the rest remains in effect, and the unenforceable provision will be enforced to the maximum extent permitted. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them freely. The disclaimers, limitations of liability, indemnification, license grant, and governing-law provisions survive termination.
